Terms of Use
These Terms govern access to and use of the 4.0 Labs website and the tutoring, educational, assessment, consultation, enrichment, and related services offered by Four Point O Labs Incorporated, doing business as 4.0 Labs.
1. About These Terms
These Terms of Use govern your access to and use of the 4.0 Labs website, online forms, consultations, assessments, educational materials, tutoring programs, enrichment programs, communications, and related services.
The services are provided by Four Point O Labs Incorporated, doing business as 4.0 Labs (“4.0 Labs,” “Company,” “we,” “us,” or “our”).
In these Terms:
- “Website” means the 4.0 Labs website and its associated webpages.
- “Services” means the Website and the tutoring, educational, assessment, consultation, enrichment, and related services offered by 4.0 Labs.
- “Customer” means the parent, legal guardian, adult student, or other adult who requests, purchases, or manages Services.
- “Student” means the person participating in a tutoring, assessment, enrichment, consultation, or educational program.
- “You” means a Website visitor, Customer, Student, or other person using the Services.
By accessing the Website, submitting a form, scheduling a consultation, enrolling a Student, purchasing a Service, or otherwise using the Services, you agree to these Terms.
If you do not agree to these Terms, do not use the Website or Services.
2. Additional Enrollment Terms
Certain Services may be subject to additional written terms, including an enrollment confirmation, invoice, program description, learning plan, payment authorization, cancellation policy, consent form, health and safety policy, or other agreement provided before or during enrollment.
Those additional terms are incorporated into these Terms by reference.
If an additional written agreement conflicts with these Terms, the additional agreement will control only with respect to the specific Service or transaction it covers.
Information displayed on the Website, including pricing, program features, scheduling, instructor availability, and promotional offers, may be updated periodically. The terms shown in a Customer’s enrollment confirmation or invoice will control that Customer’s purchase.
3. Adult Customers and Minor Students
Purchases, enrollment decisions, payment authorizations, and legally binding agreements must be completed by an adult who has the legal authority to enter into the agreement.
A Student under 18 may participate in the Services only with the authorization of a parent or legal guardian.
By enrolling a minor Student, you represent that:
- You are the Student’s parent or legal guardian, or you have received proper authority from the parent or legal guardian.
- You are authorized to make educational and scheduling decisions for the Student.
- The information you provide about the Student is accurate.
- You consent to the Student’s participation in the selected Services.
- You will communicate relevant educational, accessibility, behavioral, safety, allergy, medical, or emergency information that 4.0 Labs reasonably needs to provide the Services safely.
The Website is intended primarily for parents, guardians, adult students, and other adult decision-makers. Children under 13 should not independently submit forms, create accounts, make purchases, or provide personal information through the Website.
A parent or guardian should submit information on behalf of a child under 13.
4. Educational Services
4.0 Labs may offer Services that include:
- Mathematics tutoring.
- Reading, writing, and English Language Arts support.
- Homework support.
- Study skills and organization.
- Test preparation.
- Academic assessments.
- Artificial intelligence education.
- AI agent and AI systems education.
- Investing and financial-literacy education.
- Academic consultations.
- Personalized learning plans.
- Parent or guardian progress updates.
- Other academic or enrichment programs.
Programs, instructors, subject areas, delivery formats, schedules, and availability may change.
Some Services may be delivered by employees, contractors, certified teachers, subject-matter specialists, academic coordinators, or other qualified educational professionals selected by 4.0 Labs.
4.0 Labs may assign or reassign an instructor when reasonably necessary because of scheduling, availability, performance, program needs, illness, emergency, or another operational reason.
5. Online and In-Person Services
Services may be provided online or in person, depending on the program, instructor, location, technology, and scheduling availability.
Online Services
For online Services, the Customer is responsible for providing:
- A compatible computer, tablet, or other approved device.
- A reliable internet connection.
- A working camera and microphone when required.
- A safe and reasonably quiet learning environment.
- Any required software or account access.
- Appropriate adult assistance or supervision based on the Student’s age and needs.
4.0 Labs is not responsible for interruptions caused by the Customer’s equipment, internet connection, software, household environment, or a third-party service outside our reasonable control.
In-Person Services
For in-person Services, Customers and Students must follow posted or communicated location, arrival, departure, health, safety, and conduct requirements.
Parents and guardians are responsible for timely transportation, drop-off, and pickup unless another arrangement has been approved in writing.
Unless otherwise agreed in writing, 4.0 Labs does not accept responsibility for supervising a Student before the scheduled session begins or after the scheduled session ends.
6. Independent Educational Provider
4.0 Labs is an independent educational-services provider.
Unless expressly stated in writing, 4.0 Labs is not affiliated with, sponsored by, approved by, certified by, or endorsed by:
- A public or private school.
- A school district.
- A college or university.
- A standardized-testing organization.
- A textbook publisher.
- A financial institution.
- A technology or artificial intelligence company.
- A government agency.
- Another tutoring or educational company.
References to third-party schools, technologies, tools, curricula, standards, software, or products are provided only for identification, compatibility, instruction, or informational purposes.
All third-party trademarks and names remain the property of their respective owners.
7. Academic Results and No Guarantee
4.0 Labs is committed to providing thoughtful, personalized educational support. However, academic outcomes depend on many factors outside our control, including attendance, effort, participation, school instruction, assignment completion, learning needs, prior knowledge, family support, and the amount of time available.
We do not guarantee:
- A particular grade or grade-point average.
- Passing an assignment, class, test, or examination.
- A specific increase in a test score.
- Admission to a school, college, university, scholarship, or program.
- Completion of a course within a particular period.
- That a Student will reach every academic goal.
- That an instructor will be available at every requested time.
- That the Services will satisfy the requirements of a particular school or teacher.
Statements about potential academic improvement describe goals and intended benefits, not guaranteed results.
Customers remain responsible for reviewing school requirements, monitoring grades, communicating with the Student’s school, and making final educational decisions.
8. Academic Integrity
Students must use the Services honestly and consistently with their school’s academic-integrity rules.
4.0 Labs may explain concepts, review work, provide examples, help Students study, offer feedback, and guide Students through assignments. However, the Services are not intended to:
- Complete graded work on a Student’s behalf.
- Take tests or examinations for a Student.
- Impersonate a Student.
- Access a school system without authorization.
- Produce work that a Student falsely represents as entirely their own.
- Help a Student cheat, plagiarize, evade monitoring, or violate school policies.
Customers and Students are responsible for understanding and following the rules established by their schools, instructors, testing organizations, and educational programs.
4.0 Labs may refuse or discontinue assistance that it reasonably believes would violate academic-integrity requirements.
9. Artificial Intelligence Education
Artificial intelligence instruction is provided for educational purposes.
AI technologies may produce incorrect, incomplete, biased, outdated, fabricated, or inappropriate information. Students should not assume that AI-generated information is accurate merely because it appears confident or polished.
Students are expected to:
- Evaluate and verify AI-generated information.
- Use trustworthy sources.
- Protect personal and confidential information.
- Follow school rules concerning AI use.
- Cite or disclose AI assistance when required.
- Avoid using AI to cheat or misrepresent authorship.
- Use age-appropriate tools with parent or guardian supervision.
4.0 Labs does not guarantee the availability, accuracy, safety, performance, or continued operation of any third-party AI platform.
Access to a third-party AI tool may be governed by that provider’s terms, privacy policy, age requirements, and account rules.
4.0 Labs is not responsible for a Student’s independent use of an AI tool outside a supervised 4.0 Labs session.
10. Investing and Financial-Literacy Education
Investing in the Real World and similar programs are educational programs intended to introduce financial concepts, responsible decision-making, and long-term thinking.
The information provided through these programs:
- Is for general educational purposes.
- Is not individualized investment, legal, tax, accounting, or financial advice.
- Is not a recommendation to purchase, sell, or hold a particular security, cryptocurrency, investment, or financial product.
- Does not create an investment-adviser, broker, fiduciary, or financial-planner relationship.
- Does not guarantee any financial result.
Investing involves risk, including the possible loss of money.
Students should not open accounts, transfer funds, trade securities, purchase financial products, or make financial decisions without the involvement of a parent or guardian and, where appropriate, a qualified licensed professional.
Any simulations, examples, historical results, or hypothetical investments are provided for illustration and do not guarantee future performance.
11. Consultations and Assessments
A free consultation, callback, intake conversation, or initial recommendation does not guarantee enrollment, instructor availability, a particular schedule, or acceptance into a program.
Assessments are educational tools intended to help identify possible strengths, gaps, or areas for additional support. They are not:
- Medical evaluations.
- Psychological evaluations.
- Special-education evaluations.
- Clinical diagnoses.
- Disability determinations.
- Guarantees of school placement or performance.
Customers should consult a qualified medical, psychological, educational, or legal professional when a formal evaluation or diagnosis is needed.
12. Scheduling, Attendance, and Rescheduling
Sessions are subject to instructor, program, location, and scheduling availability.
Customers are responsible for confirming session dates, times, locations, formats, and time zones.
Students should arrive or log in on time and be prepared with required materials. A late arrival may reduce the amount of instructional time available. Sessions generally will not be extended because of a Student’s late arrival.
Unless a different policy is stated in the applicable enrollment confirmation:
- A Customer should provide at least 24 hours’ notice to cancel or reschedule a session.
- With timely notice, 4.0 Labs will use reasonable efforts to provide a make-up session, subject to instructor and scheduling availability.
- A session canceled with less than 24 hours’ notice may be treated as used and may not qualify for a refund, credit, or make-up session.
- A missed session or failure to attend without notice may be treated as used.
- Make-up sessions are not guaranteed at a particular date or time.
- If 4.0 Labs cancels a session, we will provide a reasonable opportunity to reschedule or provide an appropriate credit or refund.
Program-specific rules concerning session expiration, unused hours, make-up sessions, and rollover eligibility will be disclosed during enrollment.
Repeated lateness, missed sessions, disruptive conduct, or scheduling problems may result in a schedule change, instructor change, suspension, or termination of Services.
13. Fees and Payments
Prices and included Services will be disclosed before enrollment or purchase.
Unless otherwise stated:
- Fees are quoted and charged in United States dollars.
- The Customer is responsible for applicable taxes and processing charges.
- Payment may be required before Services begin.
- The Customer represents that they are authorized to use the selected payment method.
- A failed or declined payment may delay or suspend Services.
- Completed sessions and Services already provided are nonrefundable except where required by law.
- Promotional credits have no cash value and may be subject to eligibility requirements and expiration dates.
4.0 Labs may use a third-party payment processor. We do not directly control that processor’s systems, security procedures, availability, or processing time.
The Customer remains responsible for fees due under an applicable enrollment commitment even if the Student chooses not to attend, except where cancellation rights are expressly provided by law or in the enrollment confirmation.
14. Monthly Plans and Recurring Payments
Some programs may be offered as monthly plans, installment arrangements, or other recurring-payment services.
Before recurring billing begins, 4.0 Labs will disclose the material billing terms, which may include:
- The amount charged.
- The billing frequency.
- The initial enrollment period.
- Any minimum commitment.
- The renewal date.
- The cancellation method.
- Material restrictions on refunds or credits.
By enrolling in a recurring-payment plan and providing a payment method, the Customer authorizes 4.0 Labs or its payment processor to charge the applicable recurring fees until the plan is canceled or otherwise ends according to its disclosed terms.
A minimum enrollment commitment cannot be ended early merely by stopping attendance, removing a payment method, or disputing an authorized charge.
After any disclosed minimum commitment has been completed, a Customer may cancel future renewals by contacting 4.0 Labs before the next billing date. Cancellation may be requested using the published email address or telephone number.
Unless otherwise stated, cancellation takes effect at the end of the already-paid billing period. Partial-month refunds are not provided except where required by law or expressly approved in writing.
4.0 Labs will provide advance notice of a material increase in a recurring plan’s price before charging the increased amount.
15. Refunds and Credits
Refund eligibility depends on the Service purchased, whether Services have begun, any enrollment commitment, and the cancellation terms disclosed at purchase.
Unless otherwise stated in writing:
- Fees for completed sessions are not refundable.
- Fees for late cancellations or missed sessions are not refundable.
- Digital materials that have been delivered or accessed are not refundable.
- Administrative, assessment, registration, or setup work already completed may be nonrefundable.
- Credits may be limited to future 4.0 Labs Services and have no cash value.
- A credit or courtesy exception in one situation does not require 4.0 Labs to provide the same exception in another situation.
Nothing in these Terms limits a refund or cancellation right that cannot legally be waived.
Customers should contact 4.0 Labs promptly if they believe a charge is incorrect.
16. Student Conduct and Safe Learning Environment
Students, Customers, employees, contractors, and instructors are expected to treat one another respectfully.
Prohibited conduct includes:
- Harassment, bullying, discrimination, threats, or intimidation.
- Violence or unsafe behavior.
- Sexual, obscene, or highly inappropriate conduct.
- Possession of weapons, illegal substances, or dangerous materials.
- Intentional damage to property.
- Disruptive behavior that materially interferes with instruction.
- Recording another person without required permission.
- Sharing another person’s private information.
- Misuse of technology, accounts, or communication systems.
4.0 Labs may remove a Student from a session or suspend or terminate Services when reasonably necessary to protect Students, families, personnel, property, or the learning environment.
When appropriate, 4.0 Labs will attempt to communicate concerns to the Customer before termination. Immediate action may be taken when conduct presents a safety, legal, privacy, or security concern.
17. Health, Medical, and Emergency Information
Customers are responsible for providing accurate emergency-contact information and notifying 4.0 Labs of relevant allergies, medical conditions, accessibility needs, behavioral concerns, or other circumstances that could affect safe participation.
4.0 Labs personnel do not provide medical care, diagnosis, counseling, medication management, or emergency transportation as part of ordinary tutoring Services.
In an apparent emergency, 4.0 Labs may contact the Customer, an emergency contact, emergency services, or another appropriate authority.
The Customer is responsible for medical, transportation, or emergency-response expenses incurred for the Student, except to the extent otherwise required by law.
A Student who has symptoms of a contagious illness or presents a health or safety risk may be asked to participate online, reschedule, or leave an in-person location.
18. Session Recordings, Photographs, and Publicity
Customers and Students may not record audio or video of a session without advance permission from 4.0 Labs and every person whose consent is legally required.
4.0 Labs will not use a Student’s name, recognizable image, voice, school name, testimonial, academic record, or personal story in public advertising without separate appropriate permission from the Student’s parent or guardian, or from the Student if the Student is legally able to provide consent.
Consent for publicity or promotional use is voluntary and is not required to purchase tutoring Services.
Operational security cameras at an in-person location, if any, may be used for safety and security purposes and will not be treated as instructional recordings.
19. Student Work and Submitted Materials
Students and Customers retain ownership of original schoolwork, writing, artwork, projects, and other materials they create.
By submitting materials to 4.0 Labs, the Customer grants us a limited, nonexclusive license to access, copy, display, annotate, and use those materials only as reasonably necessary to:
- Provide the Services.
- Review the Student’s work.
- Prepare instructional materials.
- Track academic progress.
- Communicate with the Customer.
- Maintain business and educational records.
- Meet legal, safety, or compliance obligations.
The Customer represents that they have the right to share submitted materials with 4.0 Labs.
Customers should not submit confidential school records, passwords, protected testing materials, or another person’s private information unless reasonably necessary and authorized.
20. 4.0 Labs Intellectual Property
The Website and 4.0 Labs materials may contain text, graphics, logos, photographs, videos, lesson plans, worksheets, assessments, software, designs, trademarks, curricula, and other content owned by or licensed to 4.0 Labs.
Except as expressly permitted, you may not:
- Copy, reproduce, republish, sell, or commercially distribute 4.0 Labs materials.
- Remove copyright, trademark, or ownership notices.
- Share paid materials with people who are not enrolled.
- Record or redistribute tutoring sessions.
- Use our materials to operate or promote a competing service.
- Misrepresent yourself as affiliated with 4.0 Labs.
- Use the 4.0 Labs name or logo without written permission.
Customers and Students may download or print materials made available to them for their own personal, noncommercial educational use.
No ownership rights are transferred by providing access to the Website or Services.
21. Acceptable Website Use
You agree not to:
- Use the Website or Services for an unlawful, fraudulent, or harmful purpose.
- Attempt to gain unauthorized access to a system, account, database, or network.
- Introduce malware, malicious code, or disruptive technology.
- Interfere with the operation or security of the Website.
- Scrape, harvest, or collect information through automated means without permission.
- Impersonate another person or misrepresent your identity.
- Submit information that is knowingly false or misleading.
- Infringe another person’s copyright, trademark, privacy, publicity, or other rights.
- Use the Website to harass, threaten, exploit, or harm a minor.
- Attempt to circumvent payment, enrollment, access, or security requirements.
We may restrict or block access when we reasonably believe these Terms have been violated.
22. Privacy
Our collection, use, storage, and disclosure of personal information are described in the 4.0 Labs Privacy Policy.
The Privacy Policy is incorporated into these Terms by reference.
Customers are responsible for reviewing the Privacy Policy before submitting information about themselves or a Student.
Parents and guardians may contact 4.0 Labs with questions about information collected from or about a minor, including requests to review, correct, or delete information where applicable.
23. Electronic Communications
By submitting your email address or telephone number, you authorize 4.0 Labs to contact you about:
- Your inquiry or callback request.
- Scheduling and enrollment.
- Payment or account matters.
- Session reminders.
- Student progress.
- Program changes.
- Safety or operational concerns.
- Other transactional matters related to the Services.
Consent to receive marketing text messages is not a condition of purchasing Services.
Where required, promotional emails and text messages will be sent only with appropriate consent. You may unsubscribe from promotional emails using the unsubscribe option provided or reply “STOP” to eligible promotional text messages.
You may continue to receive communications that are reasonably necessary to administer an active enrollment, process a transaction, address safety, or comply with law.
Message and data rates may apply.
24. Third-Party Services and Links
The Website and Services may rely on or link to third-party services, including website hosting, scheduling, payment processing, email, video conferencing, cloud storage, analytics, learning software, and artificial intelligence tools.
Third-party services are governed by their own terms and privacy policies.
4.0 Labs does not control and is not responsible for:
- A third party’s content or policies.
- A third party’s data practices.
- Service outages or technical failures.
- Changes to a third-party product.
- A third party’s decision to suspend or terminate access.
- Purchases made independently through another website.
A link or reference to a third party does not mean that 4.0 Labs endorses or is endorsed by that party.
25. Service Changes, Interruptions, and Force Majeure
We may modify, postpone, relocate, convert, or cancel a Service when reasonably necessary because of instructor availability, weather, facility issues, illness, public-health concerns, technology failure, security incidents, government action, natural disaster, transportation disruption, or circumstances outside our reasonable control.
When practical, we will notify affected Customers and provide a reasonable rescheduling option, credit, substitute format, or refund based on the circumstances and applicable enrollment terms.
4.0 Labs will not be liable for a delay or failure caused by circumstances outside its reasonable control.
26. Suspension and Termination
A Customer may stop using the Website at any time. Ending Website use does not automatically cancel an enrollment, payment obligation, or minimum commitment.
4.0 Labs may suspend or terminate access to the Website or Services if:
- Fees remain unpaid.
- These Terms or an enrollment agreement are violated.
- A Student or Customer creates a safety or security risk.
- Conduct materially disrupts instruction.
- Information provided during enrollment is materially false.
- Continuing the relationship is unlawful or operationally impractical.
- 4.0 Labs discontinues the applicable program.
If 4.0 Labs terminates a prepaid Service for reasons unrelated to the Customer’s or Student’s conduct, we will provide an appropriate refund or credit for Services not provided.
Sections that by their nature should survive termination—including payment obligations, intellectual-property provisions, disclaimers, liability limitations, and dispute terms—will remain effective.
27. Disclaimer of Warranties
To the fullest extent permitted by law, the Website and Services are provided on an “as available” basis.
4.0 Labs does not promise that:
- The Website will always be uninterrupted, secure, or error-free.
- Every feature or program will remain available.
- Every instructor will be available at a requested time.
- Every educational resource will be free from errors.
- A third-party tool will operate without interruption.
- The Services will produce a particular academic or financial result.
Nothing in these Terms excludes an express written promise contained in a specific enrollment agreement.
Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent permitted by law.
28. Limitation of Liability
To the fullest extent permitted by law, 4.0 Labs and its officers, directors, employees, instructors, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the Website or Services, including loss of data, opportunity, income, academic standing, or anticipated results.
To the fullest extent permitted by law, the total liability of 4.0 Labs for a claim relating to paid Services will not exceed the amount the Customer paid for the specific Service giving rise to the claim during the six months immediately preceding the event giving rise to the claim.
For a claim relating only to free Website access, total liability will not exceed one hundred dollars.
These limitations do not apply to liability that cannot legally be limited or excluded, including liability arising from fraud, willful misconduct, gross negligence, or personal injury to the extent applicable law prohibits such limitation.
29. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless 4.0 Labs and its officers, directors, employees, contractors, and agents from third-party claims, damages, liabilities, and reasonable expenses resulting from:
- Your unlawful use of the Website or Services.
- Your material violation of these Terms.
- Materials you submit without proper authority.
- Your infringement of another person’s intellectual-property, privacy, or other legal rights.
- Fraudulent or intentionally harmful conduct by you.
This section does not require you to indemnify 4.0 Labs for its own negligence, unlawful conduct, or breach of these Terms.
30. Informal Dispute Resolution
Before filing a lawsuit concerning these Terms or the Services, the parties agree to make a good-faith effort to resolve the dispute informally.
A written dispute notice should include:
- The name and contact information of the person raising the dispute.
- The Student’s name, when relevant.
- A description of the issue.
- Relevant dates and transactions.
- The resolution requested.
The receiving party will have 30 days to review and respond before either party files a lawsuit, unless immediate legal relief is reasonably necessary or the applicable filing deadline would expire.
Nothing in this section prevents either party from bringing an eligible claim in small-claims court or reporting a concern to a government agency.
31. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, any lawsuit concerning these Terms or the Services must be filed in a state court located in Fort Bend County, Texas, or a federal court with jurisdiction serving Fort Bend County, Texas.
Each party consents to the personal jurisdiction of those courts.
32. Changes to These Terms
We may update these Terms to reflect changes in our Services, business practices, technologies, or legal obligations.
The revised Terms will display an updated effective date.
Changes will apply prospectively when posted unless a different effective date is stated. A material change affecting an existing paid enrollment will not retroactively alter the material financial terms of that enrollment without appropriate notice or agreement.
Continued use of the Website after revised Terms become effective constitutes acceptance of the revised Website terms.
33. Miscellaneous
These Terms and any applicable enrollment documents constitute the agreement between the parties concerning the Website and Services they cover.
If a provision is found unenforceable, the remaining provisions will remain in effect. The unenforceable provision will be interpreted or modified only as much as necessary to make it enforceable.
A failure to enforce a provision does not waive the right to enforce it later.
You may not assign an enrollment or transfer your rights under these Terms without written permission from 4.0 Labs. 4.0 Labs may assign these Terms as part of a merger, reorganization, financing, sale, or transfer of its business or assets.
Section headings are provided for convenience and do not affect interpretation.
These Terms do not create a partnership, joint venture, employment relationship, agency relationship, fiduciary relationship, or school-student relationship beyond the educational Services expressly described.
