With appropriate authorization, a Customer may ask 4.0 Labs to communicate with a Student’s school, teacher, counselor, or other educational representative.

We may then receive or exchange information such as:

• Academic deadlines.
• Teacher observations.
• Grade or progress information.
• Areas requiring additional support.

We will use this information to support the Student and administer the Services for which authorization was provided.

Parents and guardians are responsible for confirming that they have the authority to authorize the requested communication.

E. Accessibility, Safety, and Emergency Information

A Customer may provide information about:

• Relevant medical conditions.
• Behavioral or sensory needs.

4.0 Labs is not a medical provider, and providing health-related information does not create a medical-provider relationship.

When a Customer purchases a Service, we or our payment provider may collect:

11. Artificial Intelligence and Educational Technology

Some 4.0 Labs programs teach Students about artificial intelligence, AI agents, AI systems, and responsible use of technology.

AI tools can process information differently from traditional educational software. They may retain prompts, generate inaccurate responses, or process information under the provider’s own terms.

Our privacy practices for AI-supported instruction include the following:

1. We instruct Students not to enter private, confidential, school-protected, financial, medical, or personally identifying information into a public AI tool.
2. We seek to use fictional, deidentified, or limited information when demonstrating public AI tools.
3. We do not intentionally submit identifiable Student educational records to public AI systems for model training.
4. We do not use AI-generated profiling as the sole basis for a decision that determines a Student’s eligibility or enrollment.
5. AI-generated recommendations are reviewed by an instructor or appropriate staff member before being used for a significant educational decision.
6. Parents may ask which AI or educational tools are expected to be used in a particular program.
7. A third-party AI provider’s collection and use of information are governed by that provider’s own terms and privacy policy.

Students and parents should review the age restrictions and parental-consent requirements of third-party technology platforms.

A Student should not create or use an account with a third-party AI provider in violation of that provider’s age requirements.

12. Online Sessions and Video-Conferencing Services

Online tutoring may be delivered through a third-party video-conferencing or learning platform.

The platform may process information such as:

• Participant name.
• Email address.
• IP address.
• Device information.
• Session date and time.
• Audio and video transmitted during the session.
• Chat messages.
• Shared files.
• Technical diagnostic information.

Students should participate from an appropriate environment and avoid displaying private documents or sensitive background information.

Online sessions are not recorded by 4.0 Labs unless:

4.0 Labs will not use a minor Student’s name, recognizable photograph, voice, video, school name, testimonial, academic record, or personal story in public advertising without appropriate separate permission.

Publicity consent is voluntary and is not required to purchase ordinary tutoring Services.

Customers and Students may not record a tutoring session without advance permission from 4.0 Labs and every person whose consent is legally required.

• Payment and transaction records may be retained for tax, accounting, fraud-prevention, and legal-compliance purposes.
• Marketing contact information is retained until the person unsubscribes or the information is no longer needed.
• We may retain a limited suppression record after an unsubscribe request so that we do not send additional marketing communications.
